Terms of Sale, Shipping, and Returns
JS Ceramic Art Studio OÜ (registration code 14809509, Estonia, Harjumaa, Tallinn, +37258513327) is the owner of the online store www.bonithebichon.com (hereinafter referred to as the Online Store). Contact Information: info@bonithebichon.ee
The language offered for the conclusion of the agreement is English. These terms regulate the legal relationship arising between Online Store and the person who made the purchase (Client) in the purchase of goods of the brand Boni The Bichon from the Online Store.
The Online Store may change the terms of the e-store and the prices of the products and services. Changes will be notified in the Online Store’s environment. The terms and prices applicable at the time of the transaction taking place are applied to the transaction.
Validity of the Sales Contract, Product, and Price Information
The prices of the products sold in the online store are indicated next to the products. All prices are displayed in Euros (EUR).
JS Ceramic Art Studio OÜ is liable for VAT in Estonia, and thus VAT is included in the product prices. In some cases, Client order may be subject to import duties and taxes (including VAT), incurred once a shipment reaches Client´s destination country. Online Store and its owner JS Ceramic Art Studio OÜ is not responsible for these charges; they are Client´s responsibility as the customer.
The fee for delivering the goods depends on the location of the Client and the method of delivery unless stated otherwise. The delivery fee is added to the price of the products and delivery charge calculated and displayed to the Client when completing the order.
Information about the product is provided directly next to the product in the Online Store.
The Online Store has the right to withdrawal the transaction and ask back the product from the Client if the price of the product in Online Store is wrongly marked significantly lower than the actual market value.
Forming the Order
To order goods, Client must add the desired products to the shopping cart. The quantities in the basket may be changed and products may be removed from the basket until paying for the products.
To complete the order, Client must fill in the required data fields and select the payment method. The amount of the fee will then be displayed on the screen, which can be paid using the offered payment solutions.
If the Online Store offers a personalization option for the product, the customer must follow the instructions provided in the product description.
The order is deemed finalized after pressing the “Go to pay” button and receiving the payment. The Online Store will send a notification for the confirmation of the order to the Client’s email address.
The contract comes into force upon the receipt of the payment to the current account of the Online Store.
If the ordered goods cannot be delivered due to unavailability or for any other reason, the Client will be informed as soon as possible. The money paid (including delivery costs) will be returned without delay, but no later than 14 days after sending the notice.
The Client will pay for the purchases made in the Online Store 100% in advance. Payment takes place in a secure environment outside the Online Store – when paying with a credit card or Apple Pay in the secure environment of Stripe (www.stripe.com) or PayPal (www.paypal.com), respectively. The Online Store does not have access to the Client’s bank and credit card details.
Delivery
The goods are delivered to all the European Union Member States, unless stated otherwise in the product description.
The shipping costs for the goods are borne by the Client, and the corresponding price information appears at order checkout unless stated otherwise on the website of Online Store. The fee may differ according to the destination
Shipments generally arrive at the destination specified by the Client within 5-10 working days from the entry into force of the sales contract unless stated otherwise on the website of Online Store. Delivery times are estimated and cannot be guaranteed. During high sales seasons or National Holidays, delivery may be delayed due to reasons beyond control of Online Store. In exceptional cases, the goods may be delivered within 45 calendar days.
Return and Refund Policies
After receiving the order, the Client has the right to withdraw from the contract concluded in the Online Store within 14 days from receiving the product by submitting an application for withdrawal via e-mail. The Online Store will confirm receipt of the withdrawal application with a notice sent to the Client.
The right of withdrawal does not apply if the Client is a legal entity.
The 14-day right of return does not apply to goods that have been made considering Client’s personal needs (e.g., personalized products) or made by special order.
The Client is obliged to return the product within 14 calendar days from the date of submission of the application for withdrawal. The period of withdrawal shall be calculated from the day the Client or a third party named by him or her, who is not the carrier of the goods, has received the possession of the product. If the order consists of more than one shipment, the deadline for withdrawal is calculated from the date of arrival of the last parcel to the Client.
Until the returned package has arrived, Online Store can not take the responsibility. Therefore, please keep the document given when posting the package to prove the shipping when needed. The cost of returning the goods is borne by the Client, unless the return is due to the item not corresponding to what was ordered (e.g., a wrong or defective item).
Eligibility for Refund or Exchange
To be eligible for a refund or exchange, all physical products must meet the following criteria:
Items must be clean and packaged in the original, unmarked packaging.
All accessories, labels, free gifts, bonus items, manuals, and documentation that shipped with the product must be included.
To exercise the 14-day right of return, the ordered goods must not be used in any manner other than what is necessary to ascertain the nature, characteristics, and functioning of the goods, similar to testing items in a physical store.
If the goods have been used for purposes other than verifying their nature, characteristics, and functioning, or if they show signs of use or wear, the Online Store reserves the right to reduce the refundable amount according to the decrease in the value of the goods or to decline the refund.
Refund Process
Upon receipt of the returned goods, the Online Store will refund the Client immediately, but no later than 14 days after receiving the withdrawal, for all fees received under the contract.
If the Client has explicitly chosen a delivery method other than the cheapest usual delivery method offered by the Online Store, the Online Store is not obligated to refund the cost that exceeds the amount associated with the usual delivery method.
Right to File a Claim
If the goods purchased from the Online Store have defects for which the Online Store is responsible, it will replace the defective goods. If replacement is not possible, the Online Store will refund all fees associated with the sales contract to the Client.
Under EU legislation within European Union Countries, The Online Store is responsible for the nonconformity to requirements and defects of the products for 2 years from the receipt of the products by the Client. Thereat, within the first six months after delivery to the Client, it is presumed that the deficiency was present upon delivery. The Online Store is responsible for refuting this presumption.
On discovering the nonconformity to requirements of the product or defects of the product the Client undertakes to notify the Online Store immediately but no later than within 2 months from becoming aware of the nonconformity by sending the respective information to the email address info@bonithebichon.com.
In case of a nonconforming or defective product the Client has the right to claim the performance of obligations from the Online Store, withdraw from the contract or to cancel the contract. In case of nonconformity of the product to requirements or defects, the Client has the right to first demand the free mending of the product or replacement with a product conforming to the requirements and without defects or to return the product at the Online Store’s expense.
The Client has the right to demand the reduction of the purchase price of the product or the termination of the contract if the Online Store is not able to mend or replace the product or mending or replacing the product fails.
In case of returning a nonconforming product, the Client will be compensated for the sums paid for the product together with transport costs to the bank account specified by the Client within 14 days at the latest. The Online Store has the right to delay returning the sums paid until the Client has returned the product in his possession or submitted evidence of handing over the product to the post office for returning.
The undertaking shall, during the first six months of the transfer of the item to the purchaser, cover the costs to the Client related to repairing or replacement of the item, in particular transport, mail, work, travel and material costs. In the next 1.5 years, the corresponding costs will be borne by the undertaking only if the claim is justified. The undertaking does not reimburse the costs incurred by the Client in the event of non-compliance or deficiencies in the product and is not liable for them, if:
The Product has deteriorated/been damaged due to the fault of the Client.
Defects have been caused by the use for a non-intended purpose, incl. as a result of not following the care instructions.
The Product has changed due to normal wear of ordinary use.
There is no copy of the document certifying the purchase.
Dispute Resolution
In case disputes have arisen between the Client and Online Store on the defects of the product, the Client has the right to turn to the Online Store with a complaint, by specifying in a complaint submitted in writing or in a form allowing for written reproduction (email) his name and contact details, the date of submitting the complaint, the defect existing in the product and the solution requested by him. The Online Store will respond to the Client’s complaint in writing or form allowing for written reproduction (email) within 15 days.
In case the Client and Online Store do not reach an agreement regarding the dispute, the Client has the right to turn to the consumer complaints committee at the Estonian Consumer Protection Board (www.komisjon.ee) for out-of-court settlement of the dispute and use the European Union Online Dispute Resolution procedure at http://ec.europa.eu/odr. Reviewing a complaint in the consumer complaints committee is free of charge for the parties. Dispute settlement at the Estonian Consumer Protection Board is guided by the legislation of the Republic of Estonia.
On not agreeing with the decision of the commission the parties have the right to turn to the local county court of the Client.
Direct Marketing and Personal Data Processing
The Online Store uses the personal data entered by the Client (including name, phone number, address, email address, and bank details) solely to process the order and send the goods to the Client. Our policies regarding personal data use are disclosed in our Privacy Policies.
The Online Store will send newsletters and offers to the Client's email address only if the Client has expressed a desire to receive such communications by entering their email address on the website and indicating their wish to receive direct mail notifications.
The Client can opt out of offers and newsletters sent to their email at any time by notifying us via email or by following the instructions provided in the email containing the offers.
